Terms of Purchase and Refund Policy
1. Introduction
Welcome to HireTrainVA LLC (“HireTrainVA,” “we,” “us,” or “our”).
These Terms & Conditions govern your use of our services, including virtual assistant hiring, training, onboarding, ongoing support, business consulting, continuity programs, digital products, and free resources (such as lead magnets and webinars).
By accessing our website, engaging our services, or purchasing our products, you agree to these Terms in full. If you do not agree, you must not use our services.
2. Business Use Only
Our services are intended exclusively for use by business owners, entrepreneurs, and organizations. Unauthorized use, resale, redistribution, or licensing of our services, systems, or materials without written permission is strictly prohibited.
3. Intellectual Property
All materials – including but not limited to documentation, training, branding, assessments, tools, templates, and process workflows – are the intellectual property of HireTrainVA LLC. You are granted a non-transferable, limited-use license for internal business use only. Any unauthorized copying, resale, or distribution is strictly prohibited and may result in legal action.
4. Payment Terms
Payment is required upfront to initiate service. This includes:
A setup fee, which is non-refundable and covers job scoping, sourcing, vetting, and candidate presentation.
An ongoing monthly service fee, billed in advance of each 30-day cycle.
Late payment may result in suspension of services, forfeiture of candidate access, and termination of any guarantees or support.
Any additional services – such as upgrades, support add-ons, or a hire-away fee if you decide to bring the VA in-house – will be outlined in your service contract or agreement.
5. Replacement Policy
This replacement policy applies exclusively to clients on an active monthly-recurring service plan.
As part of our ongoing support, we maintain responsibility for oversight, performance, and continuity of your assigned virtual assistant.
If your VA becomes unavailable or is not a fit, we will provide a replacement as needed, at no additional cost, as long as your service is active and your account is in good standing.
Replacements are not available outside of active monthly service. If service is canceled, paused, or terminated, the replacement benefit ends and cannot be reinstated retroactively.
6. Digital Products and Services
All digital products (courses, templates, training modules, downloads) are final sale. Refunds will not be issued once access has been granted. If you encounter access issues, you must notify us within 5 calendar days of purchase.
7. Warranties & Results
Our hiring system is built to identify high-performing virtual assistant talent.
However, success depends on your internal operations, management, and delegation practices.
We do not guarantee:
- Business outcomes (e.g., sales increases, growth),
- Specific performance results,
- Compatibility beyond the replacement period.
All services are provided “as is” and without warranties beyond what is explicitly stated herein.
8. Limitation of Liability
HireTrainVA shall not be liable for indirect or consequential damages including (but not limited to) lost profits, lost data, or operational downtime.
Our total liability for any claim will not exceed the total amount paid for the service in the prior 30-day period.
9. Subscriptions and Payment Plans
For services billed monthly or offered on a payment plan:
100% of the agreed payment is due, regardless of usage, cancellations, or pauses.
Failure to complete payments or maintain billing will result in termination of access and forfeiture of any guarantees, deliverables, or support.
Partial or pro-rated refunds are only issued if explicitly outlined in the signed service contract. If not specified, no refunds will be provided.
10. Coupons & Promotions
Promotional offers and coupon codes:
- Are time-limited and may not be combined unless specifically authorized,
- May be revoked at our discretion in cases of misuse or abuse,
- Do not apply retroactively to previous purchases.
11. Confidentiality & Security
We require all candidates to sign a non-disclosure agreement (NDA) prior to working with clients.
However, you are responsible for:
- Managing system access (email, CRM, tools),
- Implementing appropriate safeguards for sensitive data,
- Providing role-specific expectations and documentation.
HireTrainVA is not liable for data breaches or internal misuse by any party after placement.
12. Service Suspension or Termination
We reserve the right to suspend or terminate service with clients who:
- Fail to remit timely payment,
- Display abusive or inappropriate behavior toward team members or VAs,
- Breach terms related to confidentiality, scope, or use of our materials.
Such terminations may be immediate and without refund.
13. Modifications
We may update these Terms & Conditions at any time without notice. Your continued use of our services constitutes acceptance of the most recent version.
14. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Florida, USA. All disputes shall be resolved exclusively in Florida courts.
